1. Acceptance of Terms
By accessing or using Fincroscope ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately stop using the Service. These Terms constitute a legally binding agreement between you and Fincroscope. They apply to all visitors, users, and others who access or use the Service.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Description of Service
Fincroscope is a loan management and financial planning tool that helps users track, analyze, and optimize their loans. The Service provides EMI calculators, amortization schedules, prepayment analysis, loan comparison tools, and other financial planning features designed specifically for Indian borrowers.
4. Not a Financial Institution
Fincroscope is NOT a bank, non-banking financial company (NBFC), credit institution, or financial intermediary. We are not registered with, licensed by, or regulated by the Reserve Bank of India (RBI), Securities and Exchange Board of India (SEBI), or any other financial regulatory authority. We do not lend money, accept deposits, offer credit, process payments, or facilitate any financial transactions. The Service is a software tool that performs mathematical calculations based on inputs you provide. Any reference to banks, interest rates, or RBI guidelines on the Service is for informational context only and does not imply any affiliation, endorsement, or partnership with those institutions.
5. Financial Disclaimer & No Professional Relationship
The calculations, projections, and information provided by Fincroscope are for informational and educational purposes only. They DO NOT constitute financial advice, investment advice, tax advice, legal advice, or any other type of professional advice. Your use of the Service does not create any fiduciary, advisory, or professional relationship between you and Fincroscope. You should consult with qualified financial professionals, chartered accountants, or legal advisors before making any financial decisions. We are not responsible for any financial decisions you make based on information from the Service. Tax benefit calculations (e.g., Section 80C, 24(b), 80E) shown on the Service are simplified estimates and may not reflect your actual tax liability — consult a qualified tax professional for advice specific to your situation.
6. Accuracy of Information
While we strive to provide accurate calculations and information, we do not guarantee the accuracy, completeness, timeliness, or reliability of any calculations, interest rates, regulatory information, or content displayed on the Service. 7. Beta Service
Fincroscope is currently in BETA. This means the Service is still under active development and may contain bugs, errors, or incomplete features. By using the Service during this beta period, you acknowledge and agree that: (a) features may change, be added, or removed without notice; (b) data loss or service interruptions may occur; (c) you use the Service at your own discretion and risk; (d) we are not liable for any loss or damage arising from beta-related issues. We appreciate your feedback during this beta period and are continuously working to improve the Service.
8. User Accounts
To access certain features of the Service, you may be required to create an account using third-party authentication providers such as Google. You are responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activities that occur under your account; (c) notifying us immediately at fincroscope@gmail.com of any unauthorized use of your account. We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. Your use of third-party authentication services is also subject to the terms and policies of those providers.
9. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service for any illegal or unauthorized purpose; (b) attempt to gain unauthorized access to any portion of the Service, its systems, or networks; (c) interfere with or disrupt the Service, servers, or connected networks; (d) transmit any viruses, malware, or other harmful code; (e) collect or harvest any information from other users without their consent; (f) use the Service to generate misleading or fraudulent loan documentation; (g) use automated scripts, bots, or scrapers to access the Service without prior written consent; (h) reverse-engineer, decompile, or disassemble any part of the Service.
10. Intellectual Property
The Service and its original content, features, functionality, design, code, and branding are owned by Fincroscope and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of the Service without our prior written consent. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
11. User Data & Privacy
You retain ownership of any data you input into the Service. By using the Service, you grant us a limited, non-exclusive license to use your data solely for the purpose of providing and improving the Service. Your financial data is stored with encryption — even our team cannot access your personal financial details in plaintext. Our collection, use, and protection of your data is governed by our Privacy Policy, which forms an integral part of these Terms. 12. Third-Party Links & Content
The Service may contain links to third-party websites, including but not limited to Reserve Bank of India (RBI) circulars, bank websites, and regulatory resources. These links are provided for informational convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. You access third-party links at your own risk and should review their terms and privacy policies independently. The inclusion of any link does not imply affiliation with or endorsement by Fincroscope.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINCROSCOPE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINCROSCOPE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY ERRORS, INACCURACIES, OR OMISSIONS IN CALCULATIONS OR CONTENT; (C) UNAUTHORIZED ACCESS TO YOUR DATA; (D) ANY THIRD-PARTY CONDUCT ON THE SERVICE; OR (E) ANY FINANCIAL DECISIONS MADE BASED ON INFORMATION FROM THE SERVICE. SINCE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE THOUSAND INDIAN RUPEES (₹1,000).
15. Indemnification
You agree to indemnify, defend, and hold harmless Fincroscope and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content or data you submit through the Service.
16. Termination
You may stop using the Service at any time. You may request deletion of your account and associated data by contacting us at fincroscope@gmail.com. We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your account data after a reasonable retention period as described in our Privacy Policy; (c) provisions of these Terms that by their nature should survive termination will survive, including but not limited to Sections 5, 13, 14, 15, and 19.
17. Service Availability & Force Majeure
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecommunications failures, power outages, cyberattacks, or acts of third-party service providers.
18. Changes to Terms
We reserve the right to modify these Terms at any time at our sole discretion. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also provide notice via email (if you have an account) or through a prominent notice on the Service. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service.
19. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, the seat of arbitration shall be Bengaluru, India, and the language of arbitration shall be English. The courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction for any matters not subject to arbitration or for enforcement of arbitral awards.
20. Severability & Entire Agreement
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fincroscope regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
